The Chief Metropolitan Magistrate, Egmore, has recently directed the CB-CID to register a case without any delays pertaining to an infringement of copyright. The complaint in this regard was filed by Novex Communications Private Limited against the producer of the movie ‘Master’.Master is a 2021 Indian Tamil-language neo-noir action-thriller film which is directed by Mr. Lokesh Kanagaraj. He is the person who also wrote the screenplay with the help of two persons i.e., Rathna Kumar and Pon Parthiban. The film stars actors like Vijay and Vijay Sethupathi in lead roles. And actors Malavika Mohanan, Arjun Das, Andrea Jeremiah, and Shanthanu Bhagyaraj have been cast in supporting roles in the movie. The film revolves is all about an alcoholic teacher whose name is JD in the movie and that role is being played by Vijay. This alcoholic teacher takes a teaching job for three months in a juvenile home which is controlled by the nefarious Bhavani (Sethupathi).
On the other hand, Novex Communications Private Limited is a Non-govt. the company which was incorporated on 03 Apr 2002. The company is a private unlisted company that is being classified as a ‘company limited by shares’. However, Company's authorized capital stands approximately at Rs 100.0 lakhs and even has 52.0% paid-up capital which equals Rs 52.0 lakhs. Novex Communications Private Limited has its hands on majorly in the businesses of Community, personal & Social Services from last about 19 years and even company operations are still active till date.
Advocate T. Pazhanivel is representing Novex Communications Private Limited. He asserts in the court that his client holds the on-ground performance copyrights for music from several Tamil movies. Such songs cannot be played without getting prior permission at any hotel or event. But during the music release function of the movie “Master”, a few numbers of the songs were played to welcome the celebrities on their entry. Copyrights of such played songs were owned by Novex Communications Private Limited. The music release event was held at Leela Palace Hotel.
“This is an infringement of copyright. We submitted a complaint with the CB-CID in September and as there was no action on it, we filed complaints the next month too. As there was inaction from the police, we filed a case at the Egmore Chief Metropolitan Magistrate Court,” said Mr. Pazhanivel.
However, the Court stated after going through the petition and documents that a cognizable offense had been made out and also directed the concerned Intellectual Property Rights and Copyright wing of the CB-CID to register a case based on the complaint filed by the company without any further delays.
