Copyright Infringement Issue on Choppa Style Instrumental

Professional New Orleans Disc Jockey (DJ) has filed a copyright infringement lawsuit on "Choppa Style." Kirk Edwards, also known as DJ JMK, sued Darwin Turner, known as Choppa, and Percy Miller, known as Master P, and several other artists for their use of his instrumental work on "Choppa Style.’ The complaint is filed before the US District Court for the Eastern District of Louisiana.

Copyright protection is measured from the publication date of the music. The owner of the infringed work can pray before the Court for an injunction as a remedy. The Court can award damages and instruct to destroy the counterfeited products on the basis of the complaints.

Choppa Style, the soundtrack of the Saints' season, was very famous in 2000. DJ JMK claimed that he created an instrumental called "Choppa Style Instrumental" and eventually linked with rapper Choppa to add lyrics to create a song called "Choppa Style". He claimed that the song became popular and they made a deal with ‘Take Fo' Records to include the song on Choppa's album. But DJ JMK narrated that ‘Take Fo' Records recreated that song, without paying him his dues. Further DJ alleged that the duplicate version of the song copied his "horn riff, arrangement and melody" and used "a piano to copy the horn melody and arrangement" of his song.

According to the DJ, there was a deal with Choppa and Master P's No Limit Record. Another unauthorized version of the song was created as Choppa Style Remix featuring Master P. Kirk Edwards alias DJ JMK is a Music producer, Filmmaker at JMK Production.JMK said that he made the instrumental in November 2000 and played it at clubs. The track, "Choppa Style," has over nine million streams on YouTube, and a small chunk of that track has been sampled in other notable tracks.

JMK made allegations of copyright infringement against other defendants. Last year in the mega music video “Twerk”, Cardi B and City Girls plagiarized a portion of 'Choppa'. Belcalis Marlenis Almanzar known professionally as Cardi B is an American rapper, singer, songwriter, actress, and television personality. City Girls is a rap duo from Miami consisting of Yung Miami and JT.

Yo Gotti and French Montana are also accused of committing infringement. According to the suit, they did it on "Oh Yeah" in 2017. They are also rappers. According to Edwards, all the defendants plagiarized his instrumentals in various other tracks without his permission. DJ JMK claimed royalty and damages for the infringement caused by the defendants. The case is filed on 12th August 2019.
