Munich Oktoberfest enters the list of Registered Trademarks

Good news is on its way for those who admire the Munich Oktoberfest, it is a protected trademark now! A decision was passed by the EU Intellectual Property Office (EUIPO) based in Alicante, Spain, approving the application of the Munich city administration seeking trademark protection for Germany’s most loved and famous folk. This decision is a result of five years of long examination. The trademark protection was initially granted till the year 2026.

The main aim of the Munich city administration is to prevent Oktoberfest profiteers behind the registration of trademarks. However, the term “Oktoberfest” has been granted protection for 22 product classes which includes tourism advertising, and also for products and services related to the categories starting from soap and credit cards to uniform rental.

Trouble in Munich City Hall was recently triggered when news came of the plan made by some business people to hold a replacement of Oktoberfest on a large scale on the lands of Dubai. “Now it is legally fixed what has been true for me for a long time: There is only one Oktoberfest, and that in Munich,” said Mayor Dieter Reiter.

Wiesn boss and economics officer Clemens Baumgärtner (CSU) said: “I’m concerned with the question: Do you want to cash in with Munich, and does that damage Munich?” The big line is important to him. “If it is said that the Oktoberfest is now moving to Dubai, then that is excessive. That is not possible; we are taking action against it.”

For the CSU politician, there are many small Oktoberfests taking place around the globe which are different from which Munich even benefits. He cited the USA as an example: “The Oktoberfest in Cincinnati never tried to copy Munich, it can be seen under the advertising category.”

The Bavarian original is now almost comprehensively protected under trademark law. The city administration has played a vital role in achieving this historic victory. They also protected several combinations of terms such as “Munich Oktoberfest” and “Oktoberfest Munich”. Apart from these two, they also protected “Wiesn”, “Oide Wiesn”, or “Oktoberfest Oide Wiesn Munich”. All these applications went through in Alicante way back even earlier than the pure Oktoberfest.

It is pertinent to mention here that the term ‘almost comprehensive' does not mean completely. There has been a completely separate brand entry for the ‘Oktoberfest Dublin’ for many years, and the Segmüller upholstered furniture factory has remained the owner of the rights over the term ‘Wiesn’ for three product classes in furniture since the year 2012.

“Wiesnkönig”, “Wiesnschönheit” and “Wiesn vegetarian” are some of the other examples which are also protected but behind each of these brands are business people and not the state capital. It is undoubtedly great news for fest lovers and even for the people who are involved in the organization of fests.
