A trademark is also not limited to a business name but can also include a phrase, logo, symbol, design, image, or a combination of these elements. As mentioned above, this mark cannot be similar to any other trademark. A mark can use the same words as another mark, as long as the marks are not deceptively similar.

To standardize the goods or services, which the trademark will represent, the Trademark Registry has classified all types of goods and services in 45 categories. The trademark application must mention the type of goods or services the trademark will represent under one or more of the classes, and trademark registration is granted for that specific class of goods or service. Any person claiming to be the proprietor of a trade mark used or proposed to be used by him may apply in writing in prescribed manner for registration. The application should contain the trade mark, the goods/services, name and address of applicant and agent (if any) with power of attorney, period of use of the mark and signature. The application should be in English or Hindi. It should be filed at the appropriate office.

Since there are so many factors that can affect the process, it is difficult to determine how long it will take for an application to mature into a registration. In most cases, an applicant receives a filing receipt approximately 20 days after filing. Ordinarily, you could receive a response from the trademark Office within six to seven months from filing the application. However, the total time for an application to be processed may be anywhere from two to several years, depending on the basis for filing, and the legal issues which may arise in the examination of the application.

The ® mark can be used once the trademark registration is provided by the Controller General of Patents Designs and Trademarks.

A registered trademark is valid for a period of 10 years from date of filing. The trademark owner can file for renewal before the end of the current validity.

  • Please avoid selection of a geographical name. No one can have monopoly right on it.
