In accordance with section 135 of the Trade Marks Act, in an action for infringement of a registered trademark, or in an action for passing off for either a registered or unregistered mark, the court may order an injunction along with damages or an order for account of profits along with the delivery of the goods bearing the infringing marks, for destruction or erasure. In addition to the civil remedies, the Trade Marks Act contains stringent criminal provisions relating to offenses and penalties.
